Cancellation and refund policy of HICONSTRUCT LTD

1. The principle

HICONSTRUCT LTD invoices for work performed. If an engagement is cancelled before the work begins, there is normally nothing to pay. If work has already been carried out — interviews scheduled, films shot, data pulled, an outsourced team staffed — that work is invoiced, because it has consumed real time and real cost. On a contingency search no sourcing fee is charged, as set out in section 2. There are no cancellation fees beyond the value of the work already done, the minimum term of a retained engagement set out in section 3, and the fixed-price rules set out in section 5, and no penalty for cancelling, apart from the thirty-day notice period that has to be paid at the standard monthly rate once the three-month minimum term on a retained engagement has passed.

This policy describes the terms of service in one place. If a statement of work for a specific engagement sets out a different arrangement for a specific deliverable, that statement of work applies to it, and we send it to you for review before the engagement starts.

2. Contingency placements — 22% and 25% of first-year salary

If you cancel a contingency search before any candidate starts, the fee is $0. Nothing is owed for the sourcing work already carried out on that role, because on a contingency engagement we only charge when a hire happens.

If a candidate has started and you end the employment relationship inside the ninety-day replacement window for reasons connected to the role, the placement fee is not refunded and no further fee is charged: HICONSTRUCT LTD repeats the search instead, at no additional cost. If the person leaves for reasons that are not connected to the role, the window does not apply and the fee already paid stands.

3. Retained engagements — from $7,900 per month

Retained engagements run for a minimum of three months, so the minimum commitment is three monthly fees. If you cancel inside that minimum term, the amount due is that three-month commitment: the monthly fee multiplied by three, whether or not the full three months were worked, because the sourcing capacity was reserved in advance. We invoice monthly in advance, so those three monthly fees are charged across the term.

If you cancel after the minimum term, you give thirty days written notice and you pay for the thirty-day notice period at the standard monthly rate, in addition to the fees for the months already worked. Unused monthly fees already paid are not refunded, because the recruiter capacity was reserved for your roles during that time.

4. Contract and project staffing — from $85 per hour

Hourly work is billed for hours actually worked. If you end an assignment early, you pay for the hours delivered up to the end date; the remaining hours of that week are not billed. Work delivered at short notice or on weekends is billed at $95 per hour instead of $85 — that is the same single surcharge listed in the service lines and in the terms of service, and it applies to the hours actually worked.

5. Fixed-price projects

• Employer branding — from $4,500 per project: the fee covers the brief, the shoot day, editing and delivery. If you cancel before the shoot day, you pay $900 for the preparation work already completed: interviews, the story outline and the shot list. If you cancel after the shoot day, the full project fee applies even though the editing and delivery stage is not finished, because the shoot has already happened and the footage cannot be un-filmed.
• HR analytics — from $1,800 per quarter: the fee is a fixed quarterly price covering analysis, reporting and the review call. If you cancel mid-quarter, you pay for the weeks of that quarter already elapsed, and you receive the dashboard and the reports produced so far.
• Relocation and visa support — from $2,400 per relocation: the fee is invoiced once the relocation is confirmed. If the relocation is cancelled before it is confirmed, there is nothing to pay. If it is cancelled after the visa application has been filed, the government and provider charges already incurred are passed through at cost, and the remaining coordination work is credited to you.
• Outplacement support — from $950 per person: the fee covers a six-week programme. If a participant withdraws in the first two weeks before any session has taken place, the fee is $0. After that point the programme fee stands, and the participant keeps the materials produced so far: the rewritten CV and the interview preparation notes.

6. Candidate screening — from $65 per candidate

Screening is paid per candidate as the check is performed, because the cost is incurred with the screening provider at that moment. If a check is started and the candidate withdraws before it completes, you pay the checks already completed. If a check is requested and cancelled before it is started, there is nothing to pay.

7. How a credit or refund is processed

Where the numbers above mean you have paid for work that was not completed, HICONSTRUCT LTD issues the credit on the next invoice rather than as a separate transfer, unless you ask for a separate transfer. The only exception is an unused prepaid monthly fee on a retained engagement, which is not credited, because the recruiter capacity was reserved for your roles during that time. Refunds, where they are due, are returned by the same method that was used to pay: a card payment goes back to the card, a bank transfer goes back to the originating account. Refunds are processed within ten working days of the written request being approved.

Invoices are issued monthly and payable within fifteen days of the invoice date. Credit notes are issued with the same numbering sequence as invoices, so your accounts team can match them without a phone call.

8. Surcharges and minimums

There is one surcharge in our price list: urgent and weekend contract work at $95 per hour against the standard $85. There is no cancellation fee, no admin fee and no minimum commitment on contingency searches. On a retained engagement after the three-month minimum term, the only charge on cancellation in addition to the fees for the months already worked is the thirty-day notice period at the standard monthly rate. Retained engagements have a three-month minimum because the sourcing capacity is reserved in advance, and that figure is $7,900 per month as set out on the service lines page.

9. How to raise a cancellation or a credit request
